Who we are and what Gamobby is

Gamobby ("we", "us", "our") is a social network designed exclusively for gamers. Our platform allows users to create a gamer profile, connect their existing social network accounts, and discover other gamers within their social circle who share the same gaming interests.

Gamobby is operated by Gamobby ("the Company"). Our registered contact email is info@gamobby.com.

Eligibility and account creation

To use Gamobby you must:

• Be at least 16 years of age. If you are between 16 and 18, you confirm that you have the consent of a parent or legal guardian where required by your local law.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the service under applicable law.
• Not have had a Gamobby account previously terminated for breach of these Terms.

By creating an account you confirm that all information you provide is accurate, complete and up to date.

Your Gamobby account

Your Gamobby tag

When you create an account you choose a unique username called your Gamobby tag. This tag is your identity on the platform and is visible to other users depending on your privacy mode. Your tag must not impersonate another person, use offensive language, or infringe any third-party trademark.

Account security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at info@gamobby.com if you suspect any unauthorised use of your account.

One account per person

Each person may maintain only one Gamobby account. Creating multiple accounts to circumvent a suspension or for any other reason is prohibited.

How Gamobby uses your social network data

This is the most important section for understanding how Gamobby works. Please read it carefully.

What we access

When you connect a social network (Instagram, TikTok, X/Twitter, Facebook), we request access to:

• Your public profile information (name, username, profile picture)
• Your follower and following list — the accounts you follow and that follow you back
• We do not access your private messages, stories, posts, or any content you publish on those platforms

Why we access it

We use your social graph exclusively to:

• Identify mutual connections between Gamobby users who have connected the same social network
• Suggest potential matches — other Gamobby users who are within your social circle and share gaming interests
• Populate your lobby with relevant people you may already know

What we never do

• We never post, publish, share or interact with anything on your behalf on any social network
• We never sell your social graph data to advertisers or third parties
• We never use your social data for purposes beyond matching within Gamobby
• We never store your social network passwords or login credentials

Revoking access

You can disconnect any social network from your Gamobby account at any time from your profile settings. You can also revoke Gamobby's access directly from the settings of each social network. Revoking access means we will no longer use that network's data for matching, but previously established connections on Gamobby will remain unless you delete them manually.

User conduct and community rules

Gamobby is a community built on respect. You agree not to:

• Harass, bully, threaten or abuse any other user
• Post or share content that is hateful, discriminatory, or promotes violence
• Impersonate any person, company, or entity
• Use Gamobby to spam other users with unsolicited messages or connection requests
• Attempt to access other users' accounts or personal data without authorisation
• Use automated bots, scripts or tools to interact with the platform
• Attempt to reverse-engineer, scrape or copy any part of the Gamobby platform
• Use Gamobby for any commercial purpose without our written consent

Violations of these rules may result in immediate account suspension or termination. Serious violations may be reported to law enforcement.

Content you post on Gamobby

You retain ownership of any content you create and post on Gamobby (your bio, gaming tags, profile information). By posting content you grant Gamobby a non-exclusive, worldwide, royalty-free licence to display that content within the platform for the purpose of operating the service.

You are solely responsible for the content you post and confirm that it does not infringe any third-party rights.

Privacy modes: Open, Squad and Scout

Gamobby offers three privacy modes that you can switch between at any time:

• Open: Your profile is visible to all Gamobby users. Anyone can find you and send a match request.
• Squad: Your profile is only visible to users who are within your connected social circle — people you mutually follow on a connected social network.
• Scout: Your profile is invisible to other users. You can browse and explore profiles freely, and choose who to reveal yourself to by initiating contact.

Gamobby does not guarantee that your profile will never be seen outside your chosen mode. We take reasonable technical measures to enforce privacy modes but cannot be held liable for unintended exposure caused by user behaviour or third-party technical issues.

Matching and connections

Gamobby's matching system suggests potential connections based on shared games, platforms and social graph proximity. A connection is only established when both users express mutual interest.

Gamobby does not guarantee the quality, safety or suitability of any connection made through the platform. You are responsible for exercising your own judgement when interacting with other users.

We reserve the right to modify, suspend or discontinue the matching algorithm at any time without prior notice.

Intellectual property

All elements of the Gamobby platform — including but not limited to the name, logo, design, code, features and content produced by Gamobby — are the property of the Company and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of Gamobby without our prior written consent.

Disclaimers and limitation of liability

Gamobby is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.

To the maximum extent permitted by law, Gamobby shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the service.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim (or €50 if you have not paid anything).

Termination

You may delete your Gamobby account at any time from your account settings. Upon deletion, your profile and all associated data will be removed from public view immediately and permanently deleted from our servers within 30 days, in accordance with our Privacy Policy.

We may suspend or terminate your account at any time if you violate these Terms, without prior notice or liability. If we terminate your account without cause, we will give you reasonable notice where possible.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and display a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of Gamobby after the effective date constitutes acceptance of the updated Terms.

If you do not accept the updated Terms, you may delete your account before the effective date.

Governing law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

If you are a consumer resident in the European Union, you also have the right to submit a complaint to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
